1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and SCRIPTTHEMARKET LLC ("Company," "we," "us," or "our") concerning your access to and use of RSVPlinks (the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Description of Service

RSVPlinks is an online platform that allows users to create event invitations, generate shareable links and QR codes, collect RSVPs, and manage guest lists. The Service also includes public host profiles and a Community feed, AI-assisted content generation, optional add-ons (Sign-Up Lists, Table Management, RSVP Fee, and Marketing Email), and an admin-curated blog and survey system. The Service is offered in both free and paid tiers with varying features and limitations as described on our pricing page.

3. Account Registration

To use certain features of our Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Send spam, unsolicited messages, or phishing attempts
• Use the Marketing Email add-on to send to recipients who have not provided consent under applicable anti-spam laws (including the U.S. CAN-SPAM Act, Canada's CASL, the EU GDPR / ePrivacy Directive, and the UK PECR), or to remove or alter the unsubscribe link we include in every campaign
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users, including via host profiles, follower notifications, or the Community feed
• Create events, polls, surveys, or profiles for illegal activities
• Impersonate any person or entity, including by spoofing host identity in Marketing Email or on a public profile
• Use AI-assisted content generation to produce content that infringes third-party rights, defames others, or violates these Terms
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Collect user information without consent, including scraping public host profiles or guest lists
• Use automated means to access the Service without permission

5. User Content

You retain ownership of content you create using our Service ("User Content"), including event details, images, and descriptions. By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of providing and promoting the Service.

You represent that you have all necessary rights to your User Content and that it does not violate any third-party rights or these Terms.

5.1 AI-Assisted Content

When you use our AI features (banner generation, description generation, social-media drafts, admin blog drafts), your prompts are sent to a third-party AI provider for processing and the generated output is returned to you. You are responsible for reviewing AI-generated content before publishing it, and for ensuring it does not infringe third-party rights, mislead guests, or violate these Terms. We make no warranty as to the originality, accuracy, or non-infringement of AI-generated output, and ownership of such output is governed by the AI provider's terms.

6. Subscription Plans, Add-Ons, and Payments

6.1 Free Tier

We offer a free tier with limited features. Free tier events are subject to RSVP limits and certain feature restrictions as described on our pricing page.

6.2 Paid Tiers (Per-Event Pricing)

Paid tiers are purchased on a per-event basis and unlock additional features (such as larger RSVP caps, paid-tier intro animations, and access to certain add-ons) for the specific event the tier is applied to. By upgrading an event, you agree to:

• Pay all applicable fees as described at the time of purchase
• Provide accurate billing information
• Authorize us to charge your payment method through Stripe

6.3 Credit Packs

Credits purchased in bulk packs can be used to upgrade events at any time. Credits do not expire. Credit pack purchases are non-refundable once credits have been applied to events.

6.4 Add-Ons

Certain features are sold as one-time, per-event add-ons (for example, Table Management, the RSVP Fee toolkit, and Marketing Email packs). Add-ons may be bundled with a tier upgrade into a single Stripe checkout. Add-ons apply only to the event they are purchased for and are non-transferable between events.

6.5 Marketing Email Add-On

The Marketing Email add-on is sold in packs of 500 sends (currently $6 per pack), with a maximum of 5,000 sends per event. You are the sender of any campaign you compose and are solely responsible for compliance with applicable anti-spam laws (CAN-SPAM, CASL, GDPR / ePrivacy, PECR, and others that may apply to your recipients). We provide and require an unsubscribe mechanism in every campaign; you may not remove, hide, or bypass it. Once a send has been initiated, the consumed send credits are non-refundable. Unused, unsent credits remain attached to the event for the life of the event.

6.6 RSVP Fee Add-On (Peer-to-Peer Payments)

The RSVP Fee add-on lets you collect contributions from guests via external peer-to-peer payment providers (Venmo, Zelle, PayPal, Cash App, or cash at the door). RSVPlinks does not process, hold, escrow, or refund any peer-to-peer payment. We display the payment handles you choose to share and let you issue confirmation codes to guests; all payment, dispute, refund, tax, and chargeback obligations are between you and your guest. The add-on fee paid to RSVPlinks covers the use of the toolkit and is separate from amounts collected from guests.

6.7 Refunds

Per-event tier upgrades and add-on purchases are non-refundable once applied to an event. Marketing Email send credits are non-refundable once consumed. Credit pack refunds may be provided at our discretion within 7 days of purchase if no credits have been applied. Stripe processing fees are not refundable. We are not responsible for refunding peer-to-peer payments made between guests and hosts under the RSVP Fee add-on.

7. Public Host Profiles, Followers, and Community

You may publish a public host profile at /u/[your-handle]. Once published, your profile is visible to anyone with the link, including unauthenticated visitors and search engines. Other signed-in users may follow your profile and will receive notifications when you publish a new event or poll to it. Followed events and polls appear in followers' Community feed. You can hide your profile, remove individual events from it, or block followers at any time from your account settings. You are responsible for the content you publish on your profile and on the Community feed, and you grant us the same license described in Section 5 with respect to that content.

8. Surveys and Coupons

We may publish optional surveys at /survey/[slug]. Participation is voluntary. Some surveys offer a one-time-use coupon as a thank-you. Coupons are non-transferable, may not be combined with other offers unless we say otherwise, expire on the date stated at issuance, and have no cash value. We may revoke coupons obtained through fraudulent or duplicate submissions.

9. Intellectual Property

The Service, including its original content, features, and functionality, is owned by SCRIPTTHEMARKET LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our written permission.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

11. Third-Party Services

Our Service may integrate with or contain links to third-party services (such as payment processors, social media platforms, and map services). We are not responsible for the content, privacy policies, or practices of these third-party services. Your interactions with these services are governed by their respective terms and policies.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCRIPTTHEMARKET LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless SCRIPTTHEMARKET LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

15. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time by contacting us or using the account deletion feature.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
